Club Betta Terms

Club Betta is the loyalty program we offer to reward you when you sign up for Club Betta membership in-store or online on our website. These Club Betta Terms (Terms) set out the conditions on which we offer Club Betta membership, and they apply to each Club Betta member (you) in Australia. If you join Club Betta, you agree to these Terms. You should read both these Terms and our Privacy Policy carefully.

Definitions & Interpretation

In these Terms, the following definitions apply:

Betta means the individual retail businesses (or part of such businesses) operating under the Betta, Betta and Designer Appliances or Furniture Zone brands either as corporate stores of BSRF or under licence from BSRF;
BSRF, We & Us means BSR Franchising Pty Ltd ABN 21 122 556 094, which owns and operates the trademarked brands Betta, Begents powered by Betta, Designer Appliances and Furniture Zone;
Club Betta Member, and Member means where you create a login to the Site by registering your personal details;
Order means an order placed via the Site;
Personal Information has the meaning given to it under the Privacy Act 1988 (Cth);
Site means www.betta.com.au website;
Terms means these Club Betta Terms;
You and Your means the Club Betta Member.

These Terms are governed by laws in force in the State of Queensland, Australia.

Becoming a Club Betta member

  • You can apply to be a Club Betta Member if you are an individual and are at least 18 years old and reside in Australia. Corporations and businesses and non-Australian residents are not eligible to be members. Betta commercial customers are also not eligible to be members.
  • To be a Member you must provide us with details including your name, address, phone number and any other relevant details in your request. You must tell us as soon as possible of these details change. We are not responsible for any loss of Club Betta membership benefits arising from you not notifying us of any change in your contact details.
  • We do not allow joint accounts. You can only create one account per email address. You cannot share your membership with other individuals (including your family or members of your household). We may request that a member provide personal identification to verify their identity.
  • We have a right to refuse your membership for any reason.
     

Benefits of joining Club Betta


As a member you get access to various benefits offered from time to time. These may include:
 

  • 7-day price guarantee – As a Club Betta member, you receive a 7-day price promise on all purchases. See Club Betta 7 Day Purchase Price Promise for more information.
  • Monthly chance to win a $1000 or 1 of 50 x $20 Betta gift card – Betta runs a “Spin to Win” competition every month. This competition is subject to separate terms and conditions which will be available once you sign up for the “Spin to Win” competition.
  • Exclusive membership discounts: Betta offers the Club Betta Member Discount to the members via sending emails or SMS. Terms and Conditions applicable to the exclusive membership discounts.
  • Invitations to VIP sales events: Club Betta Members may receive exclusive offers and invitations to VIP sale events.
  • Annual birthday surprise: On your birthday, we make you feel special by sending a special discount code via email or SMS.
  • Faster online checkout: To shop online, ensure you are logged in to your Club Betta account when you are placing your order. To shop in-store, provide the team member serving you with your mobile number or email address that is connected to your Club Betta account.
  • Exclusive competitions and giveaways: You may also have exclusive access to the relevant competitions and giveaways.
    All benefits are subject to availability. Some benefits may be subject to separate terms and conditions that you can access on our website or may be shared with you via email or SMS.


 How do Member Communications Work?

  • Unless you have opted out, you agree to us communicating with you via various channels and media (including mail, email, SMS, MMS, telephone, and by advertising on certain websites and social media). We call these messages ‘Member Communications’.
  • You agree that you can opt out of receiving different types of Member Communications by following the instructions below:
  • Marketing emails- Clicking the unsubscribe link in the footer of those emails.
  • SMS- Text “STOP” as per the instructions in an SMS communication we send to you.
  • Product review emails- Clicking the unsubscribe link in the footer of those emails.
  • Customer experience survey emails- Clicking the unsubscribe link in the footer of those emails.
  • We may use Cookies to record your preferences in relation to your use of our Site and provide us with other information about your enquiry that allows us to recognise you in the future.
     

Terminating your Club Betta Membership

  • We may terminate your Club Betta membership if you have not logged into your account, made a purchase, or interacted with our email in more than 24 months. But you may still receive Member Communications after membership termination unless you notify us that you wish to opt-out (see clause 3.2).
  • We can terminate your Club Betta membership at any time, including if we think you have breached these Terms, or are engaging in fraudulent or inappropriate conduct that undermines our legitimate interests.
  • We can also terminate the Club Betta program at any time by posting a notice on our Site or contacting you via email.
  • After terminating your membership or the Club Betta program, we will retain and hold your personal information in accordance with Betta's Privacy Policy.
     

Liability

We are not liable for any unauthorised use of the Club Betta account. You are responsible for:

  • maintaining the confidentiality of your account and password;
  • restricting access to your computer;
  • use of the account by anyone other than you; and
  • all activities that occur under your account or password.

General

  • Where we give you notice by email or SMS, you agree that the notice is deemed to have been provided to you on the date of the email or SMS unless we are notified by your network provider that the notice has not been delivered.
  • We may amend, revise or update these Terms by posting revised Club Betta Terms on our Site from time to time. Your continued use of our Site constitutes acceptance of these revised Club Betta Terms.
