We reserves the right to modify or terminate an Account or Account details at Our absolute discretion, including the right to delete, merge or amalgamate duplicate Accounts held by you. We make no warranty to the completeness of the information that you provide Us.
Where We choose to use third-party services in conjunction with this Website, including secure payment options for purchasing Goods from the Site, you may also be required to create and maintain a separate account that may include personal and financial account details. This Website is designed for Australian customers. International accounts and purchases are welcome on the condition that purchases are made for an individual who is currently residing in Australia and the Goods purchased can be picked up from the Store of purchase.
Placing An Order For Products
You may order Products by selecting and submitting your order through the Site in accordance with these terms and conditions.
Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified at the time you place the order.
We may ask you to provide additional details or require you to confirm your details to enable Us to process any orders placed through the Site.
You agree to provide Us with current, complete and accurate details when asked to do so by the Site.
Paying For Your Order
You may pay for your order using the following payment methods: Visa; MasterCard; PayPal; Betta ElectricalGift Card.
Payment processing services offered via the Site are outsourced to third party providers. If We do not receive or are unable to successfully process payment in full for your order for any reason, We will cancel your order.
If you choose to pay by Visa or MasterCard credit card or debit card, you authorise Us to debit the amount that is payable for an accepted order from your nominated card.
You will be required to provide Us with the following details on your Visa or MasterCard; card type, name on card, card number, 3-digit card verification value (CVV2) and the card expiry date.
You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.
Order Acceptance/Confirmation
After you place an order using Our shopping cart, We will check the information you give Us for validity, by verifying your method of payment or shipping address.
We reserve the right to reject any order you place with Us for any reason whatsoever. If We reject your order, We will attempt to notify you using the e-mail address you have given Us with the order.
Your credit or debit card will normally not be charged if We reject an order, but We will process a refund if the charge has been made against your card.
No committment to stock availability is made on our website.
Order Limitations
We reserve the right to reject any order you place with Us, and/or or to limit quantities on any order, without giving any reason.
These restrictions may include orders placed by the same Team Betta account, the same credit card, and orders that use the same billing address.
In the event We reject an order, make a change to an order or limit an order We will attempt to notify you by contacting the e-mail and/or billing address provided at the time the order was made.
We reserve the right to limit or prohibit sales to dealers or any commercial enterprise.
If We are unable to supply all items listed on your order, this Agreement will apply to the supply of all or part of the Order.
We may Backorder Goods on your behalf if for any reason We are unable to supply any or all items listed on your order. Where a Backorder has been placed on your behalf, We will contact with you by phone following delivery at the Store.
All Backorders are subject to stock availability with Our supplier.
We reserve the right to cancel an order if you are unable to prove that you are the customer (or agent/ representative) listed on the order, or if you are ineligible to purchase goods sold on the website due to age restrictions, and We reserve the right to not provide stock if proof of; purchase, identity or age cannot be produced. To comply with our legal obligations you acknowledge that We may be required to retain a copy of any identification provided.
Cancelling an order
You may cancel an order (whether it is accepted by Us or not) by; contacting the store where the order was placed, presenting in store proof of purchase and identity. On cancelling the order, and confirmation of stock return We will refund your payment in accordance with our Refund Policy.
If We cannot stop the shipment of the order at the time of cancellation, then you will be required to refuse delivery or return the products in order to receive a refund in accordance with Our Refund Policy and;
We reserve the right to charge an administration fee to cover Our reasonable costs in respect of your cancelled order.
Despatching an order
You will be contacted when your order is ready to be collected if you have nominated Pickup Instore.
Orders are not available to pick-up at any other Store unless advised to you by the Store where you made your on-line purchase.
To protect both you and Us from fraud, before any purchases will be despatched to you, you will need to be able to prove your identity as the customer at the time of pick-up by presenting:
- The invoice emailed to you at the time of purchase;
- A current Australian Drivers License or a current Australian Passport are the ONLY forms of valid ID accepted for in store pick up.
- Any acceptable tender types used in the transaction (e.g. the Credit Card) used to Order
To protect you and Us from fraud you are unable to nominate an agent or representative to collect goods on your behalf in respect of transactions that exceed $3000.
Delivery
The Site does not organise or guarantee delivery. If you require delivery, you must contact the Store for further information.
It is the responsibility of the purchaser to go into the store and finalise the delivery details, including payment and the purchaser must be the primary card holder.
Any request to deliver Purchases to a delivery address or another Store for pick-up may incur delivery costs.
Risk and title to the Products remains with the Betta Electrical franchisee until all monies payable (including any interest, freight or insurance charges) have been paid and cheques, direct deposits or BPAY funds have cleared; and passes to you on date and time of despatch from a Store or on delivery.
Collection Delays
We will make every reasonable effort to contact you if you do not pick up your goods from the selected Store within 7 days of placing your order or another specified time.
We reserve the right to allocate goods that are not collected within 12 weeks to another customer order and reorder the goods for you.
If the Products listed on the original order are no longer available then a substitute product of similar specification and equal (or lower) cost may be supplied.
If you fail to collect your order within 12 weeks of making your purchase, a longer term can be negotiated at Our discretion, you will incur a daily storage fee (“storage fee”) which will increase everyday you do not collect your purchase. The store fee must be paid by you to Us when you collect your purchase after 12 weeks from the date of purchase or thereafter or your purchase may not be released to you by Us.
Pricing Policy
Online prices and selection match region pricing for Our stores, but may vary from State to State. Prices and offers are subject to change without notice.
The price for Goods bought from your preferred Store on the Site may be lowered after your order has been accepted but before We process payment for the transaction.
Prices displayed on this Website are in Australian Dollars ($AUD) and are inclusive of Goods and Services Tax (GST).
Advertised “Web-only” specials, promotions, are only available to purchase via this Website. The Betta Electrical franchise stores are not required to, but may price match offers made on this Website at the discretion of the Franchisee or authorised Manager and subject to the availability of stock at that Betta Electrical store.
Uncollected Goods
You will be given 12 weeks to collect your purchase; a longer term can be negotiated at Our discretion.
If your purchase is not collected within 12 weeks from the date of purchase, or longer if We consent, We will contact you by telephone and in writing and provide you with notice advising you if your purchase is not collected within the prescribed time We will dispose of your purchase pursuant to the Disposal of Uncollected Goods Act or the relevant legislation in the respective State or Territory.
Disclaimers and Limitation of Liability
By using the Site, you expressly agree that use of the Site is at your sole risk.
To the full extent permitted by law, We exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages.
To the full extent permitted by law, We exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.

(ii) the repair of the goods;

(b) in case of services:
(i) the supply of the services again; or
(ii) the payment of the cost of having the services supplied again.
We and Our affiliates, subsidiaries or designees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, "Associates") warrant that use of the Site will be uninterrupted or error-free.

The duration of these offers or quantities are subject to the disclaimer on the latest Catalogue. Although We make every attempt to make all offers consistent, it does not guarantee that the Products, pricing or any other offer in a Catalogue will be available to purchase via this Website.
Bonus Offers
All coupons, promotional codes, bonus offers or redemptions ("Bonus Offers") have different entry requirements, terms, conditions, and rewards (“Conditions of Entry”). Please check the Conditions of Entry to verify how to claim any Bonus Offer. The Conditions of Entry for any Bonus Offer will be listed separately to the Terms and Conditions.
The Conditions of Entry in conjunction with a Bonus Offer will state the value of the offer, how to redeem the offer and must be met to receive the Bonus Offer.

Using Gift Cards
Gift cards, unlike credit or debit cards, are debited at the time an order is placed. These cards will automatically be redeemed to purchase totals, up to the total purchase amount. In the event the total purchase amount exceeds the value of the card, you will be required to use another card or a credit or debit card to pay the difference. Any amount charged to a credit or debit card will be treated as set forth above.
Termination of Use
We may, in Our sole discretion, terminate your account or your use of the Site at anytime without notice and for any reason whatsoever. You are personally liable for any orders that you place or charges that you incur prior to termination. We reserve the right to change, suspend or discontinue all or any aspects of the Site at any time without prior notice for any reason whatsoever.

Additional Services
DATE OF INSTALLATION:
Salesperson has reviewed scheduling options. You must give the Betta Electrical franchisee 24 hours notice if you wish to cancel or reschedule an appointment, otherwise the Betta Electrical franchisee may at its discretion charge a cancellation or reschedule fee at the current listed rate.
ADDITIONAL CHARGES:
The installers will provide an estimate to you prior to performing work that requires an additional charge. Payments for additional charges must be made in advance.
RESPONSIBILITY:
The Installers will not be held responsible for moving any furniture or valuables. The Installer will not, under any circumstance, move, alter or install electrical outlets, unless licensed. It is recommended to have necessary electrical work performed prior to installation service.
SAFETY OF OUR WORKFORCE:
For onsite service, the working environment in which the installer is requested to perform their duties; the environment must meet the respective Occupational Health and Safety (OH & S) regulations of the respective states and/or territories. If the installer believes that the environment does not meet these requirements, then the installer at its sole discretion, reserves the right to leave the site.
INSTALLATION AUTHORISATION:
You understand that someone at least 18 years of age must be present at all times on the day of set-up to approve all work completed. If not, the installer will leave the site.
LABOUR ONLY:
Set-ups do not include any parts or accessories (for example; routers, mouse, cable, or similar parts), except where specifically listed. It is the customer’s responsibility to have Broadband /Wi-Fi connection in place and operational prior to any service being performed by the Betta Electrical Franchisee that requires such connectivity.
DISCLAIMER:
The Betta Electrical Franchisee will make its best endeavour to deliver timely service, notwithstanding unpredictable scheduling increases, unscheduled transport or sickness problems and other factors beyond our control, including but not limited to power failure, technical breakdowns and acts of God. The Betta Electrical Franchisee will provide service to the best of its ability, however, makes no guarantees as to the service quality nor does it accept responsibility and liability for ongoing service matters other than those provided for in these terms and conditions. If the installer’s ability to render services is impaired by your failure to cooperate or circumstances beyond the control of the Betta Electrical Franchisee, the Betta Electrical Franchisee may choose not to provide services. Service can also be denied if dangerous or unhealthy conditions are present. The Betta Electrical Franchisee will not disassemble, deconstruct or break down any product for haul-away services even if necessary for removal.
LIMITATION OF LIABILITY & RELEASE:
You acknowledge and agree that, except for direct property damage that results from a Betta Electrical franchisee's negligence, under no circumstances shall BSR Australia or its related entities be liable to you or any other person for any damages, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, data loss or corruption, or liability arising out of, or related to, the services provided by the Betta Electrical franchisee or the installation, use of, or inability to use your products. Further, you affirmatively release and hold harmless BSR Australia and its related entities from and against any loss, liability or damage that you or the owner or lessee may suffer. Subject
to the customers statutory rights under the Australia Competition and Consumer Act or other similar state and territory laws, all entitlements and the liability of the Betta Electrical franchisee and BSR Australia and its related entities, is expressly limited to the cost of the service being provided.
Right to Download
You may only download Content displayed on Our Site for non-commercial, personal use provided you also retain all copyright, trademark and other proprietary notices contained in the material, do not modify or alter the material and do not copy or post the material on any network computer or broadcast the material in any media.
